WICHITA, Kan. (AP) — A federal judge has dismissed an indictment against a Mexican immigrant accused of lying about his U.S. citizenship after the judge’s earlier ruling tossed out the government’s evidence obtained from questioning.
U.S. District Judge Eric Melgren on Tuesday granted the government’s motion to dismiss the indictment against Jose Manuel Ortiz-Del Rio. Prosecutors sought the dismissal a month after Melgren threw out statements the suspect made falsely claiming U.S. citizenship during questioning by immigration agents.
Melgren had earlier suppressed the suspect’s statements because federal agents did not tell him his Miranda rights when they detained him.
