Judge denies Fullens’ motions; trials set for October, November

As of Friday morning, an animal cruelty case involving a large number of animals is headed to trial.

District Judge Rene Young Friday morning dismissed all motions filed on behalf of Beverly Fullen, 66, and Matthew Fullen, 40, both of Salina.

In April, the Saline County Sheriff’s Office, after consulting with Salina Animal Services personnel, seized 189 animals from properties at the corner of Lapsley and Woodward roads and in the 5000 block of Country Club Road.

Deputies arrested Beverly Fullen and Matthew Fullen,  both of Salina, on numerous charges that included 165 misdemeanor counts and four felony counts of cruelty to animals. The Fullens had asked that the charges be dismissed, claiming in part that the deputies did not have the expertise to determine the condition of the animals, nor did they consult with a veterinarian or other livestock expert. The Fullens also cited what they called inaccurate and inflammatory remarks made about them by Salina City Commissioner Melissa Rose Hodges on her official Facebook page. Young dismissed all motions filed on behalf of the Fullens.

Matthew Fullen’s trial is scheduled to begin at 9 a.m. on October 15, 2018, and Beverly Fullen’s trial is scheduled to begin at 9 a.m. on November 14, 2018, Young said.
