Smolan man arrested after altercation Friday night

A Smolan man was arrested Friday after an incident in the Walmart parking lot.

Salina Police Captain Paul Forrester said officers were dispatched to Walmart, 2900 South Ninth, at 10:30 p.m. Friday for the report of a fight in the parking lot and a shot fired.

According to Forrester, Donald Heart, Jr., 65, of Salina, and his son, Donald Heart, III, 28, of Salina, were exiting Walmart when they were approached by Joshua Mudd, 29, of Smolan, Forrester said. There was a verbal confrontation and then Mudd allegedly punched Donald Heart, III, in the mouth, Forrester said.

At some point during the confrontation, Mudd allegedly pulled out a gun and fired a single shot, Forrester said. A .380 shell casing was found in the parking lot, he added.

Forrester said Mudd was later located at his residence in Smolan and arrested on suspicion of the following.

  • Aggravated assault
  • Criminal possession of a weapon
  • Criminal threat
  • Unlawful discharge of a firearm within the city limits
  • Battery
