The trial of an Emporia woman accused of leaving her newborn son in a trash bin at an apartment complex has been delayed for a third time.
Christina Devine had been scheduled to go on trial Oct. 17 on a charge of attempted first-degree murder. The Emporia Gazette reports that a Lyon County judge last week granted a defense request for a postponement. The trial is now set for Jan. 9, 2012.
Devine was charged after maintenance workers found her 7-pound, 10-ounce baby boy alive in October 2010. The infant had been wrapped in a trash bag and placed in a bin.
Devine was diagnosed earlier this year with a genetic disorder that causes tumors to grow in the nervous system. The continuation will give prosecutors and the defense more time to review reports on her psychological issues.
